The lawyer for a girl beaten in Marijampolė’s Poetry Park will challenge prosecutors’ decision to end the pre-trial investigation, while her family’s 300,000-euro damages claim could increase, LRT reported.
Lawyer Artūras Andriukaitis said the decision holds the parents of two minors potentially responsible through administrative proceedings but does not address the responsibility of other people involved. He said some of those who encouraged the violence were adults and should face trial.
Andriukaitis said he would appeal the decision and, if necessary, take the matter to a higher-ranking prosecutor and a court. He said the family’s claim for non-pecuniary damages may be revised because the girl’s condition is worsening. The family has chosen not to disclose further details about her health.
The incident took place on July 15. Prosecutors said the investigation found that the girl was struck dozens of times and taken to a medical facility afterward. They said the evidence indicated that a girl and a boy had committed the acts, with the boy inciting the conflict; both were under 16 at the time.
The prosecutor’s office said the decision and investigation material would be sent to the Marijampolė municipal mayor to consider supervision measures for the minors, and to the county police headquarters to consider administrative proceedings against their parents. Investigators examined video footage and questioned more than 30 witnesses.
