Supreme Court rejects Karbauskis appeal in cheque case

Lithuania’s Supreme Court has refused to accept a cassation appeal by former Tauragė District Municipality Council member Vaclovas Karbauskis in a civil case over fuel expense compensation, LRT reported.

The Tauragė District Court ordered Karbauskis in January to repay the municipality more than 15,000 euros. Prosecutors had sought the return of about 18,000 euros in fuel expenses reimbursed to him.

The case involved fuel purchases made at different petrol stations at the same time, quantities that exceeded the capacity of his vehicle’s fuel tank and the use of 13 bank cards. Karbauskis denied wrongdoing.

He appealed the district court’s ruling to the Kaunas Regional Court, which rejected the appeal in May and upheld the original decision. Karbauskis then asked the Supreme Court to overturn the procedural decisions concerning unjust enrichment and the recovery of funds, and to dismiss the prosecution’s claim.

On Monday, the Supreme Court’s selection panel issued a final and non appealable ruling refusing to accept the complaint and returned it to the appellant.

The Kaunas Regional Court’s decision therefore remains in force. Under it, Karbauskis must pay the Tauragė District Municipality slightly more than 15,000 euros, plus annual interest of 5 percent.
